ผู้ออกเช็คสั่งจ่ายเงินโดยรู้ว่าไม่มีเงินในบัญชีเพียงพอ บัญชีถูกปิด หรือออกเช็คลงวันที่ล่วงหน้าเพื่อชำระหนี้แต่ไม่มีเจตนาปฏิบัติ เช่น เช็คถูกธนาคารปฏิเสธด้วยเหตุเงินไม่พอ บัญชีปิด หรือขัดคำสั่ง และผู้ออกไม่นำเงินมาชำระหลังได้รับแจ้ง
